Justice Uwani Musa Aba-Aji, in a Supreme Court lead judgment, on Friday, dismissed an appeal by Ken Pela of the Labour Party (LP), challenging the election of Sheriff Oborevwori as governor of Delta state.
Oborevwori, candidate of the Peoples Democratic Party (PDP), was declared winner of the March 18, governorship election in Delta State by the Independent National Electoral Commission.
In a unanimous judgment, a 5-man panel of the apex court resolved all the 6 issues determined by the court against Pela and the Labour Party.
The Supreme Court held that the appeal was lacking in merit, frivolous and deserving to be dismissed, an accordingly dismissed same.
Recall that the Delta State Governorship Election Petition Tribunal sitting in Asaba, had on September 29, upheld Oborevwori as the winner of the March 18, governorship election, after dismissing Pela’s petition.
Dissatisfied with the dismissal of the petition, Pela filed an appeal at the Court of Appeal to seek redress.
Again, the Court of Appeal affirmed Oborevwori’s election, and dismissed the appeal by Pela and the SDP on November 24, 2023.
Unhappy with the dismissal of the petition by the tribunal and the appellate court, Pela and his party approached the Supreme Court, seeking the setting aside of the judgement of the two lower courts.
Pela, the LP candidate, had prayed the Supreme Court to nullify the entire election and order a fresh one.
